gpn12 NOTICE OF SEIZURE OF PERSONAL PROPERTY VALUED AT LESS THAN $25,000 Pursuant to O.C.G.A. 16-13-49 (n) (1) and (2) notice of seizure by the BARTOW-CARTERSVILLE DRUG TASK FORCE, of the property described below in Item (A), is hereby given to (1) any and all owners or interest holders of said property; and (2) the owner or interest holder of said property, has THIRTY (30) DAYS within which a CLAIM MUST BE FILED in compliance with the provisions of O.C.G.A. 16-13- 49 (n) (3) and (4). Item (A) Description of Property: $ 4,875.00 in United States currency and following six (6) firearms: 1) Taurus handgun SN: ZC36477, 2) Ruger handgun SN: 308-60537, 3) Davis Industries handgun SN: 10016485, 4) Mossberg shotgun SN: MV05953J, 5) Glock handgun SN: KUM757 and a 6) Smith and Wesson handgun SN: VAT2917. Item (B) Date and Place of Seizures: Thursday, December 6th, 2012, in the immediate area of Douglas Street @ Johnson Street, City of Cartersville, Bartow County, State of Georgia; Item (C) Conduct giving rise to forfeiture: On the date and location described in Item (B) above, agents of the Bartow-Cartersville Drug task Force, while engaged in a criminal investigation concerning the sale of methamphetamine by JOSE GARCIA, ERIC EUGENE HOUSE, ALEJANDRO BENITEZ and JEOVANY PEREZ, who occupied two vehicles while being in joint possession as parties to a crime of the United States currency and six (6) firearms, described in Item (A) above, along with a set of electronic weighing scales and distribution for sale amounts of the schedule two controlled substance methamphetamine and substance marijuana (GARCIA & HOUSE occupied one vehicle possessing three firearms and the illegal drugs). (BENITEZ & PEREZ occupied the other vehicle possessing the other three firearms to provide additional protection during the illegal drug transaction), The United States currency, six (6) firearms, weighing scales and described illegal drugs supra, were seized by law enforcement officers as contraband as allowed by the provisions of O.C.G.A. 16-13-49 (d) (1), (d) (2), (d) (3), (d) (4) and (d) (6).
